Session Description: This interactive session is open to those interested in learning information on confidentiality, particularly as it relates to HIPAA and 42 CFR Part 2. Confidentiality requirements will be presented along with specific cases where disclosure of patient information is allowed. The training will also cover how to respond to a subpoena for protected patient information. At the conclusion of the session, participants will be able to distinguish between HPAA and 42 CFR Part 2 and the confidentiality rules that govern mental health and substance use practice. Participants will be able to identify PHI that has to maintained in treatment, and discuss important elements of a Release of Information. Through case examples, participants will be able to apply confidentiality regulations and considerations to their own practice.

Distinguish at least three (3) differences in privacy and confidentiality rules for substance use counselors under HIPAA versus 42 CFR Part 2.
Identify two (2) examples of PHI that have to be maintained in treatment.
Specify three (3) conditions in which disclosures are allowed under 42 CFR Part 2.
